ANALYSIS OF RECENT LEGAL JUDGEMENTS
INTRODUCTION: The U.S. Department of Labor (DOL) recently revised the overtime rule to extend protections to more salaried workers. The Fair Labor Standards Act (FLSA) has long required that employees working over 40 hours per week receive overtime pay. However, exemptions existed for certain executive, administrative, or professional (EAP) employees based on salary thresholds. The New Rule: Effective July 1, 2024, the standard salary level defining overtime eligibility increased. Salaried workers earning less than $844 per week now qualify for overtime pay. For Workers : Millions of lower-paid salaried workers will benefit from increased overtime protections. Employees who previously worked long hours without additional compensation will now receive fair pay for their extra efforts. Job duties will continue to play a role in determining exemption status.
